Chair of Olshan's Advertising, Marketing & Promotions Group and Co-Chair of the firm’s Brand Management & Protection Group Andrew Lustigman will participate in a panel discussion at ACI’s Legal and Regulatory Think Tank for Working with Influencers, which will be held virtually on July 16, 2025, at 2:00 P.M. The panel, entitled “Navigating the Complexities of Intellectual Property in Influencer Marketing: Understanding Ownership, Right of Publicity, and Copyrights,” will explore who owns the rights to influencer-created content—brand vs. influencer—and how contracts can (and should) address usage rights, exclusivity and modifications; how the use of an influencer’s name, image, likeness or persona triggers right of publicity considerations and how proper permissions and scope of use must be clearly defined; and how to avoid common copyright pitfalls, such as use of third-party music, images or memes in influencer content, as well as outline best practices for securing licenses and avoiding infringement.
