Joseph B. Weiner

Joseph Weiner has an impressive record handling complex commercial litigations in federal and state courts, and in arbitrations.

Joe has substantial experience litigating a wide range of complex commercial disputes in courts around the country. He represents a diverse client base – media and advertising companies, real estate owners, commercial borrowers, investment funds, individuals, and others – in cases involving contract disputes, business torts, fiduciary duty breaches, unfair competition, and employment issues. Joe has successfully resolved numerous complex cases at all stages of litigation, including motion practice, jury and bench trials, arbitrations, and appeals. Joe places a premium on client communication, and always seeks to represent his clients’ rights strategically and efficiently. 

Joe has achieved many significant results in recent years. Following a five-day jury trial in Los Angeles Superior Court in January 2024, he achieved a favorable verdict on behalf of a global tourism company against a competitor’s multimillion-dollar unfair competition and contract interference claims. In 2022, Joe successfully defeated claims at arbitration by a commercial ground lease tenant seeking reimbursement for substantial renovations at the building. Joe similarly prevailed after a 2021 virtual arbitration hearing for an international chemical supplier in a dispute involving complex agency, setoff, and UCC issues. In 2020, following trial in New York State Supreme Court, Commercial Division, Joe defeated claims for fraud, breach of contract, and breach of fiduciary duties relating to investments in New York commercial buildings, with a successful affirmance on appeal.

  • Achieved a complete victory at arbitration for a commercial building owner in a ground lease dispute relating to Local Law 11 repairs.
  • Represented an industry-leading media company in several breach of contract disputes in federal and state trial and appellate courts.
  • Represented corporate clients in a variety of disputes arising out of COVID-19, including commercial and ground lease breaches, mezzanine loan defaults, and commercial mortgage foreclosures.
  • Represented a media company in an antitrust action in federal district and appellate courts.
  • Represented several companies through a Tax Court trial in which the IRS sought to disallow millions of dollars of claimed losses arising out of foreign exchange derivatives (matter handled before joining Olshan).
