Jonathan T. Koevary

Jonathan Koevary advises creditors, debtors, landlords, tenants, investors, and intellectual property licensees and licensors regarding bankruptcy, distressed situations, creditors’ rights, and corporate restructuring matters and in related litigation.

Clients rely on Jonathan to deftly guide them through all aspects of Chapter 11 and 15 cases, and to represent them in out-of-court and in-court restructurings. He has prevailed in numerous bankruptcy core matters and related litigation, in prosecuting and defending avoidance actions, prosecuting successor liability, and enforcing judgments. In his Chapter 15 practice, Jonathan represents international and domestic entities in the U.S. regarding foreign insolvency proceedings.

Jonathan also represents asset purchasers in distressed asset and distressed business M&As and sales. He is a licensed commercial airplane pilot and certified flight instructor.

  • Represented the secured lender/DIP Lender in the PFO Global Chapter 11 cases through an asset purchase and successful appeal through the United States Court of Appeals of the Fifth Circuit.
  • Provided bankruptcy advice in connection to a $121 million sale of fee position in Crowne Plaza Times Square Hotel to SL Green Realty Corp.
  • Represented a lender group through lawsuit and judgment recovery against Stadiumred, Inc.
  • Represented ad hoc committee to preferred shareholders in Washington Prime Group Inc., et al. in LC Chapter 11 cases.
  • Represented the largest consignment vendor in Neiman Marcus’s Chapter 11 cases.
  • Represented major healthcare patent licensor through litigation and successful resolution of its licensee interests in the MabVax, Inc. Chapter 11 cases.
  • Represented QRx Pharma Ltd. In its Chapter 15 case (recognition of foreign main proceeding and enforcement of Deed of Company Arrangement).
  • Representing preference and fraudulent transfer defendants in cases often exceeding seven figures.
  • Served as special litigation counsel to Chapter 7 Trustee of Diamond Finance Inc.
  • Represented an advertising company, as plaintiff, through a successor-liability suit.
  • Represented a music entertainment company in pursuit of a judgment enforcement.
  • Represented Town Sports International Inc. as special counsel.
  • Represented Surrey Realty Associates, LLC, the ground lessor, in the Chapter 7 case of the premier Upper East Side NYC hotel, The Surrey Hotel.
  • Represented the landlord in NPC Chapter 11 cases.
  • Represented the landlord in Modell’s Chapter 11 cases.
  • Represented Perry Ellis International as the auction winner of $15 million Georgia distribution center in Fred’s, Inc. Chapter 11 cases.
  • Represented and led second lien holders in the Sportco Holdings, Inc. Chapter 11 cases to successful contested plan confirmation.
  • Represented Signature Apparel Group, Inc. in connection with its bankruptcy fraud litigation against Iconix Brand Group and Christopher Laurita.
  • Represented a DIP Lender in the TerraVia Holdings, Inc. chapter 11 cases.
  • Represented DIP Lender in the Implant Sciences chapter 11 cases.
