Michael Passarella Publishes Article in NYLJ on What the End of the COVID Public Health Emergency Means for Employers

Head of Olshan’s Employment Practice partner Michael Passarella authored an article in New York Law Journal (subscription required) entitled "What the End of the COVID Public Health Emergency Means for Employers" about the COVID-19 public health emergency ending on May 11, 2023, and the impact this will have on employers. Specifically, he covers how healthcare plans will change, which also affects various other internal policies of which employers must be aware. “[E]mployers should communicate with their plan providers and employees regarding the changes coming in late spring and early summer,” writes Michael. “Employers should also review their COVID and office protocols to determine if they should make changes to their current policies. If the employer’s health plan is no longer covering [COVID] testing, the employer might consider reimbursement for testing or ending the company’s testing requirement.” He also suggested that companies could use the end of the emergencies to evaluate their COVID policies, explaining that it might be “a logical time to make a change or to loosen certain requirements [but that] companies should consider their industry and their working environment before simply making changes and should continue to deal with requests for accommodation and other issues in accordance with best practices and the law.”
