Olshan Client Jennifer Convertibles, Inc. Speedily Defeats Attempted Veil Piercing

Jennifer Convertibles, Inc. (“Jennifer”), which Olshan’s Michael Fox guided through a successful emergence from Chapter 11, defeated an attempt to pierce the corporate veil of Hartsdale Convertibles (“Hartsdale”), a Jennifer subsidiary, in Nassau County Supreme Court.  A former landlord of Hartsdale filed a complaint in February 2018, seeking alleged arrears and related charges.  Less than two weeks after Jennifer’s motion was submitted, Honorable Timothy S. Driscoll dismissed the complaint in its entirety, ruling that the landlord’s alter ego claim was insufficiently pled, and separately holding that the action was precluded on res judicata grounds by a previous action involving the subsidiary.  The Olshan litigation team was led by Nicholas Hirst and Joseph Weiner.
