Michael Passarella Leads NYSBA CLE Session on Employee Vaccination Mandates

Olshan Employment Practices partner Michael Passarella led a CLE webinar held by the New York State Bar Association (NYSBA) entitled “Mandating Your Employees Get Vaccinated? What New York Lawyers Need to Know.” The hour long webinar, which was held on September 3, 2021, reviewed issues related to employers mandating vaccinations and how to handle advising clients and providing perspectives which will assist with creating firm vaccination policies. The Queens Daily Eagle ran an article on the much-anticipated webinar and highlighted Michael’s discussion regarding the legality of vaccination mandates, in which he stated, “While COVID has created an incredible scope of issues, many of the legal issues practitioners are dealing with are not novel” and that there is, “no question, you can mandate vaccination as an employer.” Michael suggested that employers give a reasonable amount of time for their staff to comply with vaccination mandates, and by providing reasonable accommodation for exempt individuals, Mr. Passarella said this is the time, “where the rubber meets the road,” and is an area in which he has had the most clients seeking guidance.
