Harvard Law School Forum on Corporate Governance, the top online resource for discourse on corporate governance, recently published an article authored by Shareholder Activism attorney Andrew Freedman entitled “Leadership Change at the SEC: What Activists Could Expect.” The article discusses the Biden administration’s confirmation of Gary Gensler, who led the Commodity Futures Trading Commission from 2009 to 2014, to head the Securities and Exchange Commission. With Mr. Gensler expected to toughen the previous administration’s approach to regulation and enforcement, three areas are highlighted to which shareholder activists should pay particular attention to.
