Dean M. Oswald

As a member of Olshan’s Bankruptcy & Financial Restructuring Group, Dean Oswald represents clients in high-profile bankruptcies across a range of industries, including biotechnology, healthcare and retail.

Dean assists creditor committees, debtors, trustees, equity holders, purchasers of distressed assets and individual creditors in complex Chapter 11 proceedings, related litigation and corporate restructurings. His practice covers a broad range of restructuring matters, including debtor-in-possession financing, Section 363 asset sales, plan confirmation issues and all aspects of bankruptcy litigation, including avoidance actions and challenging Chapter 15 recognition of foreign proceedings. Dean regularly drafts first day motions, objections, and plan documents, appears in court, and advises clients on strategic litigation and settlement approaches.

Before joining Olshan, Dean was a bankruptcy associate at a prominent New Jersey-based law firm.

  • In re Silvergate Capital Corporation
    • Counsel to Stilwell Activist Fund L.P. Successfully defeated the Debtors’ TRO motion to block the post-petition shareholder meeting, resulting in the election of Joseph Stilwell to the board. Subsequently obtained appointment of a court examiner and negotiated a significantly improved chapter 11 plan preserving equity value for common shareholders—the original plan would have extinguished their shares entirely.
  • In re Saks Fifth Avenue
    • Counsel to consignment creditors advocating for their lien protections and recovery interests in the high-profile retail bankruptcy proceedings.
  • In re UFP Holding I, LLC
    • Counsel to secured lender in connection with the chapter 11 filing and successfully obtained dismissal of the bankruptcy case, preserving the client’s collateral position and enforcement rights outside of bankruptcy.
  • In re George Allen Weiss
    • Special litigation counsel to the Debtor in the chapter 11 case, handling complex matters to protect and maximize estate value.

    • Counsel to the official committee of unsecured creditors of Grupo HIMA San Pablo, Inc. and its affiliated debtors in their chapter 11 cases.
  • Solar Biotech, Inc.
    • Counsel to the debtors, a biotechnology company specializing in scaling biotech designs and prototypes on a commercial scale, in connection with their successful restructuring in chapter 11 cases.

    • Counsel to landlord advising on lease assumption considerations.
