Olshan Branding Attorneys Speak at PLI’s Hot Topics in Advertising Law 2026

Andrew Lustigman, Chair of Olshan's Advertising, Marketing & Promotions Group and Co-Chair of the firm’s Brand Management & Protection Group, and Advertising, Marketing & Promotions Group partner Scott Shaffer will participate in panel discussions as part of Practising Law Institute’s (PLI) Hot Topics in Advertising Law 2026 on June 10 in New York. Andy’s panel, entitled “The Changing Legal Landscape of Advertising on Social Media” and starting at 10:30 A.M., will prepare participants to assess how federal and state laws impact advertisers’ social media operational and compliance risk, including age verification, time-of-use limits, and algorithmic design rules; evaluate how emerging regulation reshapes ad targeting, campaign design, influencer marketing, and product launches on social platforms; identify key enforcement trends and litigation developments, and translate them into practical compliance guardrails for marketing teams and agency partners; and spot additional risk areas for political and issue advertising, including platform-specific eligibility requirements, audience restrictions, and emerging state rules affecting digital political ad disclosures and targeting. Scott’s panel, entitled “Right of Publicity and Advertising: NIL in the Age of AI” and starting at 11:35 A.M., will prepare participants to identify right of publicity and NIL-related risks triggered by digital performers, voice cloning and AI-generated “look-alike” content; evaluate copyright and trademark issues that arise when training, generating, or distributing synthetic content that incorporates protected works, names, logos or trade dress; structure contracts to allocate risk among brands, agencies and creative partners (including reps & warranties, indemnities, approvals and insurance considerations); apply emerging state-law requirements governing digital replicas—including the “NY Digital Performer Law”—with a focus on consent, required disclosures and recordkeeping; and implement practical safeguards for concepting, production and clearance (e.g., talent permissions, synthetic-use restrictions, disclosure language and vendor due diligence).
