Lustigman Quoted in Law360 Article About Mobile Cramming Practices

Firm News

Law360 (subscription required) reported on a recent action taken by several state attorneys general to urge the FTC to step up its scrutiny of unauthorized third-party charges "crammed" onto mobile phone bills. This has caught the attention of several attorneys, including Olshan Partner Andrew Lustigman, quoted extensively in the article, who worry not only that this will negatively impact law-abiding companies, but doesn’t fully consider consumers’ tendency to forget terms to which they have agreed, a point on which Lustigman elaborates. He explains that “consumers who complain about alleged unauthorized charges frequently modify their position once they are reminded about the facts that surround the enrollment." He also points out that existing processes for authorizing and disputing charges "in and of themselves provide strong protections for mobile device account holders.”
