Olshan Client Liquid Holdings Prevails in New York’s Commercial Division

New York Commercial Litigation Insider reported a decision in an action brought by two plaintiffs in New York’s Commercial Division for supposed breach of a joint venture agreement and related tort claims against Olshan client Liquid Holdings Group, a publicly-traded trading-technology company, a related Liquid company and one of its largest shareholders and board members. Olshan won complete dismissal of all claims on behalf of all defendants in a dispute arising from an inter-dealer business.  Justice Scarpulla dismissed plaintiffs’ claims for contract/joint venture claim as barred by the Statute of Frauds as well as remaining claims for unjust enrichment and fraud because there was no separate duty to the plaintiffs and, thus, were duplicative of the dismissed contract claim. Kyle Bisceglie and Mason Barney represented Liquid in the successful action.
