In its reporting on Tulane University Law School’s 30th Annual Corporate Law Institute, Law360 (subscription required) quoted Olshan Activist & Equity Investment Practice Co-Chair Steve Wolosky, who participated on a panel entitled “The ‘Ins’ and ‘Outs’ of Dealing with Activists.” As shareholder activism becomes ever more prolific and vigorous, investors are increasingly concerned with environmental, social, and governance matters. “About a third of the situations we deal with” Mr. Wolosky explains, “are what I call traditional value investors who have realized that there’s no stigma associated with going public with a letter or picking up a phone and talking to a board about issues that bother them, including ESG.” From Jana Partners’ call for Apple to address childhood smartphone addiction to Trian Partners’ recent modification of its website to embrace ESG, this trend has certainly gained popularity among activist investors.
