Olshan Wins Right for Class Action to Proceed
Law360 reported on an ongoing Oklahoma class action against DaimlerChrysler Corp. led by Olshan client Rhonda Masquat on account of defective steering systems. Masquat first brought the class action against Chrysler in 2005, alleging the defects would cost millions in necessary repairs. When Chrysler filed for Chapter 11 in 2009, the bankruptcy court discharged the claims as part of the company’s reorganization plan. But Masquat was granted a relief stay order in 2010. During the litigation against Chrysler, Masquat discovered that TRW Automotive US LLC made some of Chrysler’s parts and had agreed to indemnify Chrysler. Masquat continued her suit in state court, where TRW argued the litigation was a violation of the bankruptcy court’s 2010 order. Recently, Olshan attorney Michael Fox won the right for the class action plaintiffs to proceed against TRW.
