Shareholder Activism Practice Vice Chair Elizabeth Gonzalez-Sussman was quoted by Law360 (subscription required) on her recent appearance at Tulane University Law School’s 35th Annual Corporate Law Institute, one of the premier M&A, corporate and securities law conferences in the country, where she participated on the panel “Activism and ESG Considerations in Today’s World” with six experts in different areas of shareholder activism. Elizabeth spoke about why companies can often become vulnerable to activist investors. Elizabeth explained that companies often do not make comparisons to the correct peer group: “A board may think that they're OK, but they’re not really looking at, ‘How do I get to the next level? Who should be the peer that I aspire to be?’ You become vulnerable when you're not really looking at your performance with scrutiny.”
