Jeremy King Quoted in Law360 on How the Air India Disaster Is Likely to Pose Massive Insurance Costs
Chair of Olshan’s Insurance Coverage Practice Jeremy King was quoted in a Law360 article (subscription required) on the deadly Air India Flight 171 disaster and how it could implicate a range of insurance coverage proceedings. In a disaster like this, there would be insurance coverage for the hull loss (the destruction of a plane beyond repair) as well as for other liabilities, such as relating to the victim passengers, deaths and damage on the ground, workers' compensation claims and a plane manufacturer's role. A general liability policy and coverage for bodily injury would be implicated, Jeremy explained. Product liability policies and product recall exclusions could also come to bear in insurance proceedings, he added. For other kinds of insurance coverage, Jeremy said, you would need to know more about "what happened that resulted in the crash — whether it was a part failure, a human error, or something else that would have caused the situation."
