Partner Andrew Freedman was quoted in a Law360 article (subscription required) about the surge in shareholder activism and how companies should engage with activist investors. Freedman says that "It may behoove companies to take a long, hard look at themselves from a performance, governance and compensation standpoint at all times." When it comes to engaging with an activist investor, Freedman explains that, “The ideal approach from an activist standpoint is an acknowledgment by management that there are certain issues at the company that need to be addressed. And then, a willingness on management's part to engage productively and meaningfully with the activist to ensure that the right changes are enacted to address those problems."
