Corporate Counsel (subscription required) quoted Olshan Advertising partner Tamara Carmichael in an article on the FTC’s recent settlement with two Georgia companies in connection with their promotion of a new insect repellent during the 2016 Zika virus outbreak. The FTC alleged that the companies misrepresented that paid endorsements were independent consumer opinions and commercial advertising was independent journalistic content. In the complaint, the agency claimed that the companies paid two Olympic gold medalists to endorse the repellent on social media without disclosing that these reviews were endorsements. Additionally, Inside Gymnastics magazine ran misleading ads disguised as articles promoting the product and the two companies reimbursed employees for purchasing the product and posting reviews online. Ms. Carmichael concludes that this case underscores the “importance of having and implementing up-to-date branding and social media guidelines that clearly set forth influencer’s and endorser’s disclosure obligations.”
