Olshan Client eXo Prevails in Northern District
The New York Law Journal and Mealey’s reported the complete dismissal of all claims against Olshan’s client in the Northern District of New York. Olshan represented eXo, a French software company, in a dispute arising from a failed software systems integration with Australian technology company CingleVue International. Olshan attorneys Kyle Bisceglie and Mason Barney submitted a motion to dismiss, causing plaintiff CingleVue to amend, dropping a number of claims, such as breach of contract, but adding others to which Olshan responded to with a renewed motion to dismiss. In a thorough and decisively-worded decision, Chief Judge Sharpe of the Northern District dismissed all new and remaining claims for fraud, rescission, and breach of implied covenants and California state statutes.
