The Wall Street Journal’s MoneyBeat and The New York Times DealBook covered the annual M&A conference at Tulane University, citing Olshan Partner Steve Wolosky’s commentary during a panel involving the biggest names in shareholder activism. The discussion revolved around activists getting bolder about seeking majority board representation, which could lead to an increase in proxy fights even though boards are settling more and more. But, Wolosky “countered that activists don’t typically want control but seek it in rare occurrences where they see it as the only effective way to transform a struggling company.” The number of new entrants into the field of activism was also debated, and Wolosky warned that there are “a lot of people coming to this space where I question their skills. I do have concern about less-than-intelligent activists.”
