Olshan Wins Dismissal for USPA of Ralph Lauren Lawsuit

Law360 (subscription required), The AmLaw Litigation Daily, Law.com (subscription required), the Bloomberg News and other media sources reported that Judge Thomas P. Griesa of the Southern District of New York dismissed Ralph Lauren’s complaint that USPA and India-based manufacturer Arvind Inc. waived their right to arbitrate a dispute in India involving the USPA’s Double Horsemen Mark which claimed breach of a 2003 settlement agreement as part of a so-called “international shellgame.” The judge held that the plaintiff and its subsidiaries failed to establish prejudice and that, in fact, it was Ralph Lauren that caused any delay in arbitration. Kyle Bisceglie and Steven Gursky are representing the USPA.
