Lori Marks-Esterman is a senior associate in Olshan's litigation department. She represents publicly-held and private companies and individuals in a wide variety of commercial litigation matters in State and Federal Court, including disputes relating to real estate transactions, securities laws and corporate dissolutions.
Lori also has significant experience representing clients in contract disputes and employment related claims, including restrictive covenants, tortious interference with business, breach of fiduciary duty and unfair competition.
She also routinely represents clients in real estate related matters. Lori started her career at one of New York's top construction and real estate boutique law firms, and has substantial experience in commercial lease disputes and construction related issues.
REPRESENTATIVE MATTERS
Notable representations include:
• Representing a minority owner of an apparel company in multi-million dollar buy-out seeking appraisal rights in which the client ultimately received a favorable settlement payment.
• Defending an executive against claims of RICO violations, fraud, unfair competition, tortious interference, Federal Computer Fraud and Abuse Act and Penal Law violations, in separate actions in the commercial division of the Supreme Court of New York, and successfully dismissed all such claims.
• Representing a ground lessor in prosecuting claims against the ground lessee for violating the lease, and successfully negotiating resolution of those claims.
• Litigating claims on behalf of a sponsor in a dispute following a complex "cond-op" conversion, which resulted in successfully amending the Condominium Declaration and Proprietary Lease.
• Defending a real estate developer against claims of estoppel and fraud in connection with a restaurant project on Hudson Street, and achieving successful settlement of all claims in advance of trial.
• Arbitrating an employment raiding case before the NASD between two large financial institutions.
