The Litigation Group focuses on preparing cases for success at trial in an efficient manner, and it takes a significant number of matters to trial each year. Trial-readiness and preparation has been the basis for achieving favorable results for our clients not only at trial but also through settlement.

The Litigation Group represents publicly-held companies and privately-held entities and individuals in a wide range of civil litigation matters before federal and state courts, administrative agencies and self-regulatory organizations, and in arbitration proceedings. The Litigation Group specializes in corporate and securities matters including those involving securities fraud allegations, broker-dealer disputes, contests for corporate control and shareholder disputes. The group also has significant experience in a wide range of other matters including contract, employment, intellectual property, bankruptcy and real estate litigation. In addition, members of the group have substantial experience in matters involving health care regulation and white collar criminal proceedings at the federal and state levels as well as before administrative agencies and self-regulatory organizations.

The Litigation Group is routinely called upon to advise public and private companies and boards of directors in a variety of areas ranging from control and corporate governance issues to matters involving the duties owed to shareholders. The group has conducted internal investigations of both public and private entities, including one in which we were retained by the independent members of the board of directors of a publicly-held pharmaceutical company to examine claims of securities fraud and violations of FDA regulations. We have also been retained to determine the propriety of the implementation of a supplemental employee retirement plan. In addition, Olshan's litigators represent companies in business litigation in New York state and federal courts, including the Court of Appeals for the 2nd Circuit for cases involving unfair competition and Lanham Act violations.

The Litigation Group is dedicated to strong client advocacy supported by high-quality work product. At the same time, we are sensitive to the need to contain the costs of litigation. The potential outcome of each case is carefully evaluated to determine the most cost-effective strategy and the advisability of settlement.
