Employment Practices
The Employment Practices Group assists employers in managing their relationships with employees and independent contractors. We represent companies that range in size from a handful of employees to companies with thousands of employees. Our clients are publicly traded companies, private entities and not-for-profit organizations.
We are experts in the following areas:
- Negotiating employment agreements and severance agreements
- Litigating and arbitrating claims filed by former employees
- Disputes relating to employment contracts and contracts with independent contractors
- Litigations relating to thefts of trade secrets and non-competition and confidentiality agreements
- Workplace investigations and preventative counseling regarding delicate workplace situations
- Reductions in force and corporate restructurings
- Blending workforces and minimizing risks associated with corporate transactions
- Developing policies and procedures and preparing employee handbooks
- Documenting employee discipline and discharge
- Wage and hour practices and audits
We deal with the complexities of the federal discrimination statutes such as Title VII of the Civil Rights Act, the Americans with Disabilities Act ("ADA"), the Age Discrimination in Employment Act, the Equal Pay Act and their comparable state statutes. We regularly appear before the state and federal agencies and courts around the country that administer those laws.
We develop policies addressing day-to-day issues relating to the Family and Medical Leave Act, the ADA and the interrelationship between those statues and state workers' compensation and disability laws. We defend claims relating to wage and hour issues arising from the Fair Labor Standards Act and its state and city analogues.
We assist our clients in protecting trade secrets and other proprietary information through day to day counseling, the preparation of noncompetition and confidentiality agreements, and if needed, through arbitration and litigation.
